Recommendation

Staff recommends that the Mayor and Council authorize the Acting City Manager to execute Amendment Five to the Memorandum of Understanding (MOU) with the Maryland Department of Transportation State Highway Administration (MDOT SHA) for the Rockville Intermodal Access Project.

Discussion

The city is conducting the administrative project closeout process with MDOT SHA for the Rockville Intermodal Access:  Baltimore Road Project.  The construction for this project is now complete, and its scope included roadway and roadside improvements along an approximate 1.25 mile long section of the Baltimore Road corridor.  Since federal aid was utilized to fund a portion of the project, MDOT SHA assumes oversight for the project, and is required to administer federal transportation funds provided by the Federal Highway Administration (FHWA) and ensure all project elements comply with federal law and regulations.

An MOU was developed at the onset of the project to define the city and MDOT SHA roles and responsibilities.  There have been several amendments to the MOU.  MDOT SHA and city staff have coordinated on the need for Amendment Five (Attachment A), which seeks to extend the project term from December 31, 2023, to December 31, 2024.  Both the city and MDOT SHA have agreed that the term needs to be extended to finalize the remaining elements of project closeout and to process the remaining reimbursements of the federal aid to the city.  The remaining project closeout items include the final Americans with Disabilities Act (ADA) inspection and clearance, as built plan acceptance, and a final audit of construction records and documentation.  The amount of reimbursement remaining to be paid to the city is approximately $235,000.
