end

Department
City Manager's Office (CMO)

Recommendation
Staff recommends the Mayor and Council introduce the Ordinance to authorize the city manager to execute certain non-procurement related contracts and legally enforceable agreements without the prior approval and authorization of the Mayor and Council.
If the Mayor and Council wish to adopt the ordinance at this meeting, the ordinance must be introduced and the layover period must be waived by an affirmative vote of at least six (6) members of the Council. Once the motion to waive the layover period passes, the Mayor and Council may proceed to adopt the ordinance.

Discussion
Under Article VII, Section 13 of the City Charter, the Mayor and Council shall provide by ordinance rules and regulations regarding contracts for the City. As such, and in the interest of promoting good governance and meeting the body’s goal of becoming more effective and efficient at service delivery, the proposed ordinance authorizes the city manager to execute certain routine non-procurement contracts without prior approval and authorization of the Mayor and Council.
Examples of such non-procurement contracts include agreements to accept grants from other entities; agreements to acquire easements and rights-of-way; agreements with volunteer or charitable organizations that support volunteer activities at city-sponsored events; and agreements required to effectuate project plans approved by the Mayor and Council. Preparation of these contracts and agreements, for Mayor and Council consideration and approval, often requires staff resources, time, and coordination thus leading to inefficiency and ineffectiveness in service delivery.
The proposed Ordinance is attached to this staff report for your review and consideration. It is the outcome of several internal staff meetings and consultation with the Office of the City Attorney to ensure proper administration of city business.
