Recommendation

Staff recommends authorizing the City Manager to execute a Revocable License Agreement between the Mayor and Council of Rockville and KBSG Associates, LLC (KBSG) allowing KBSG and its subcontractors to enter and perform work associated with construction of a sidewalk within Mattie J.T. Stepanek Park as specified in the License Agreement and Exhibits.

Discussion

The City and KBSG, as well as Victor, Inc., as owner, entered into an Annexation Agreement dated November 3, 2021, related to the City’s annexation of the King Buick property. The Annexation Agreement includes an obligation of KBSG to design and construct a pathway on the Mattie J.T. Stepanek Park property, close to the intersection of Pleasant Drive and Farmstead Drive.

This revocable license agreement (Attachment A) allows KBSG and its subcontractors to enter onto the Mattie J. T. Stepanek Park property to construct a sidewalk measuring approximately 86 feet long by 6 feet wide, as well as the associated requirements that includes site grading and paving shown and identified on Attachment A.

Mayor and Council History

Although this is the first time this license agreement has come before the Mayor and Council, the adjacent King Farm Farmstead Park, as well as the referenced Annexation Agreement, have been brought to the Mayor and Council several times. The Mayor and Council approved the Annexation Agreement on September 13, 2021. On August 1, 2022, the Mayor and Council approved a Revocable License Agreement for KBSG to enter and perform dry utility relocation and site grading on the King Farm Farmstead Park property.  On October 24, 2022, the Mayor and Council approved a Revocable License Agreement for KBSG to construct a 47-space parking lot at King Farm Farmstead Park.

Next Steps

If approved, the City Manager will execute, on behalf of the Mayor and Council of Rockville and in a form approved by the City Attorney, the document listed below, which will be substantially similar to the draft document provided in this agenda:

1)                     Revocable License Agreement (Mattie J.T. Stepanek Park, Rockville, Maryland)

Once executed, the document listed above will be recorded by staff among the Land Records of Montgomery County, Maryland.
