Recommendation

Staff recommends that the Mayor and Council authorize the City Manager to execute a Storm Drain Easement between the Mayor and Council of Rockville and Rockshire Association, Inc., in a form acceptable to the City Attorney and substantially similar to the draft document attached to this staff report.

Discussion

This item seeks Mayor and Council approval of and authorization for the City Manager to execute on its behalf a Storm Drain Easement associated with the Rockshire redevelopment, proposed on adjoining Parcel A (2401 Wootton Parkway). The mixed-use project, approved by Mayor and Council as Project Plan Application PJT2024-00017 at its May 20, 2024 meeting, consists of 31 single-family detached dwellings, 29 townhouse dwellings, and up to 5,200 square feet of commercial use. The developer, RK Homes Associates LLC, (c/o EYA Development, LLC), is required to provide public storm drains and obtain Public Works approval and permits in accordance with the City’s Stormwater Management Ordinance, Chapter 19, and Public Improvement Ordinance, Chapter 21. The developer is coordinating with Rockshire Association (HOA) in order to provide the necessary public storm drain extension and off-site connection through the HOA’s property.

The developer is required to provide easements for all public storm drains in areas not dedicated as right-of-way (ROW). The easement gives the City rights to access the easement area for the purpose of installing, constructing, reconstructing, maintaining, repairing, operating, and inspecting City-owned storm drain infrastructure. The location of the easement is shown on Attachment A. The draft document is provided in Attachment B, “Grant of Storm Drain Easement”.
