Recommendation

Staff recommends that the Mayor and Council adopt the ordinance to correct Ordinance No. 13-24.

Change in Law or Policy

Adoption of the corrected ordinance will remove one of the conditional use requirements, in accordance with Mayor and Council direction on July 29, 2024.

Discussion

The Mayor and Council adopted Ordinance No. 13-24 on September 9, 2024, approving Zoning Text Amendment Application TXT2019-00255. Adoption allows for detached Accessory Dwelling Units (ADUs) as a conditional use in the city’s residential zones.

After adoption of the ordinance, it was noted that the conditional use requirement regarding compatibility had not been deleted from the ordinance in its entirety, as directed by the Mayor and Council. This ordinance corrects that error.

Next Steps

The corrected ordinance will be posted on the city’s website after adoption, with the effective date remaining January 1, 2025. Staff will prepare guidance documents to assist the members of the public who are interested in constructing detached ADUs.
