Recommendation
Staff recommends that the Mayor and Council award and authorize the City Manager to execute a contract responsive to Invitation for Bids (IFB) IFB# 11-26 (SC26) SWM Facilities Improvements: City Facility at the Villages of Tower Oaks Project to Magstone LLC of Union Bridge, MD. in the amount not to exceed $595,474.00.

Discussion
This agenda item is for the award of IFB #11-26, SWM Facilities Improvements: City Facility at the Villages of Tower Oaks Project. The city facility at the Villages of Tower Oaks was constructed across a tributary to Cabin John Creek in 1999. The facility is bounded by Tower Oaks Boulevard to the West, Wootton Parkway to the South, Cabin John Creek to the East, and Treasure Oak Court to the North. This project is part of the SWM Facilities Improvement: FY26-FY30 CIP SC26 (attachment 1) that is a sustainable program to maximize functionality and extend the life of stormwater treatment facilities.
In August 2023, a bathymetry survey was conducted which indicated 50% loss of overall facility storage due to sedimentation. Additionally, the facility does not currently have a forebay and the low flow frequently gets blocked by sediment. For the area to function as it was designed, sediment removal, maintenance, and other improvements are needed to restore capacity for both flood control and water quality treatment.
The Project will dredge approximately 2,725 cubic yards of sedimentation, install two forebays, and perform other facility maintenance as defined by the Dam Safety Division of the Maryland Department of the Environment (December 11, 2019 inspection), and includes furnishing of all materials, labor, equipment, tools and services, and all other associated work as specified in the contract documents. The forebays will facilitate easier removal of future sedimentation.

This is the first time this item has been brought before the Mayor and Council.

Public Notification and Engagement
Staff held a community meeting at the end of Treasure Oak Court on September 17, 2022, to present information and solicit input on the conceptual design. Material provided at the meeting included the expected project goals and outcomes, design alternatives, and the potential impacts to the community. Several direct correspondences have taken place with the HOA President, who has also disseminated information about the project to the community. A Neighborhood advisory will be mailed at least two weeks in advance of construction.

Procurement
Staff prepared and publicly advertised IFB #11-26 on February 20, 2026 in accordance with Rockville City Code section 17-61. IFB #11-26 was posted on the City website and electronically provided to 195 prospective bidders via the State of Maryland e-Marketplace Advantage (eMMA) system. Of the 195 prospective bidders, using the new systems reporting capabilities, 28 were Disadvantaged Business Enterprises (DBE), 29 were Minority Business Enterprises (MBE), and 31 were Small Business Enterprises (SBE).
Sealed bids were received and opened on April 9, 2026. The following bids were received.

Magstone, LLC is the lowest, responsive and responsible bidder for the SWM Facilities Improvements: City Facility at the Villages of Tower Oaks Project. The proposed unit prices have been deemed fair and reasonable by staff.
The SWM Facilities Improvements: City Facility at the Villages of Tower Oaks Project bid is approximately 70% of the Engineer’s estimate and allows for contingency dollars within the CIP for the construction of this project, should they be necessary. Magstone, LLC’s bid is notably lower than both the Engineer’s estimate and the next lowest bidder. However, their excellent recommendations from several local Counties in Maryland are reassuring. The bid is complete and Magstone, LLC has confirmed their understanding of the project scope. Based on the bid results, the design firm (Hazen) also recommends awarding the contract to Magstone, LLC as the lowest responsive bidder with a total bid of $595,474.00.
Staff found the references for Magstone, LLC and their subcontractors to be exemplary for this bid.
Magstone LLC is a non-Minority, Female, Disabled or Veteran (non-MFD-V) business.

Fiscal Impact
Sufficient funding is available in the SWM Facilities Improvements (SC26) CIP (Attachment 1) for award. Funding for the construction of the SWM facilities improvements at the Villages of Tower Oaks is provided within this project. This CIP assesses, designs, rehabilitates, constructs, decommissions, and maintains stormwater management (SWM) facilities throughout the City of Rockville.

Next Steps
Upon Mayor and Council award, the Procurement Department will obtain insurance certificates, one hundred percent payment and performance bonds, appropriate contract signatures, and issue a contract to Magstone, LLC of Union Bridge, MD.
