Recommendation
Staff recommends the Mayor and Council authorize the City Manager to sign Amendment I of the Memorandum of Understanding (MOU) (Attachment 1), with Maryland State Highway Administration (SHA) allowing the two organizations to continue to partner, when appropriate, on performing and/or paying for future Stormwater Management projects within the City of Rockville.

Discussion
On September 19, 2016, the Mayor and Council authorized the Acting City Manager to sign a MOU with SHA establishing a formal relationship between the City of Rockville and SHA and providing an overall framework that facilitated partnering on watershed improvement projects within the city's jurisdiction (Attachment 2). Over the past ten years, the city has partnered with SHA to implement select projects. For example, SHA funded a portion of the Croydon Creek Stream Restoration Design.
That agreement is set to expire in December 2026, and Amendment 1 extends the existing terms and conditions of the agreement to December 2036. This agreement allows the city to leverage SHA funding, when advantageous, to help achieve water quality treatment goals. This agreement does not bind the city to partnering on, or completing, any specific stormwater project.

Mayor and Council History
The Memorandum of Understanding was presented to the Mayor and Council on September 19, 2016. This is the first time Amendment I has been brought before the Mayor and Council.

Next Steps
Upon Mayor and Council approval, the City Manager will execute Amendment I with SHA in a form acceptable to the City Attorney.
