Recommendation
Staff recommends that the Mayor and Council authorize the City Manager to execute a right of entry agreement with the property owner of 1010 Aster Blvd. due to construction impacts of the Senior Center Entrance Project on W. Gude Drive.

Discussion
The City will construct a new entrance to the Rockville Senior Center on W. Gude Drive. As part of the construction, it has been determined that a Right of Entry Agreement is necessary with the adjacent property owners at 1010 Aster Boulevard. The Right of Entry Agreement will grant the City and its contractors access to the specified portions of the property, as shown on the Temporary Construction Easement Plan included with the agreement and provided (Attachment 1) to this agenda item.
The property owner agrees to grant the City the temporary right to enter the property and perform the work detailed in this Agreement, which includes the removal of six trees and the removal of the existing split rail fence and replacement with an 8-foot-tall wooden fence.
The Right of Entry Agreement has been approved by the office of the City Attorney and signed by the property owners at 1010 Aster Blvd.

Next Steps
If approved by the Mayor and Council, the City Manager will sign the right of entry agreement, and a copy will be provided to the property owner.
