Recommendation
Staff recommends that the Mayor and Council award and authorize the City Manager to execute a rider agreement for an amount not to exceed $500,000 per year with terms and pricing consistent with Baltimore County Contract SCON-10002601-1 for maintenance, repairs, replacement, and renovations of athletic court/multipurpose court services to ATC Corp. of Baltimore, Maryland, for a period of one (1) year through September 3, 2026, with the option to extend for three additional years through September 2, 2029.

Discussion
The contract will be utilized to maintain, repair, renovate and replace all types of athletic courts (basketball, tennis, pickleball, soccer courts, etc.) within various Parks and Facilities including asphalt surface overlays, resurfacing, new goals, new backboards, color coat, new playing lines, net posts and fencing repairs and replacements.

Mayor and Council History
The City previously awarded a contract to ATC Corp. as a rider under the Baltimore County contract #B-1607 in fiscal year 2022.

Procurement
Staff believes that this rider agreement is in the best interest of the city to utilize as the scope fits the city’s need for athletic court maintenance, repairs, renovation, replacement and resurfacing as well as unscheduled maintenance and safety repairs. The Baltimore County contract has multiple line items with estimated quantities larger than the city's and, as such, provide more competitive pricing based on higher volume
ATC Corp. is a Minority, Female, Disabled, or Veterans (MFD-V) business.
In accordance with Section 17-71 of the Rockville City Code, Cooperative Procurement; (b)
The City may contract with any contractor who offers goods, services, insurance or
construction on the same terms as provided other state or local governments or agencies
thereof who have arrived at those terms through a competitive procurement procedure
similar to the procedure used by the City.
In accordance with Section 17-39 of the Rockville City Code, Awarding Authority, (a) All
contracts involving more than two hundred and fifty thousand dollars ($250,000.00) shall be
awarded by the Council.

Fiscal Impact
Sufficient funding is available in Recreation and Parks, Administration Division and within the Asphalt/Concrete Improvements: FY26 - FY30 (RA26) capital improvement project to support this award. All future year funding is subject to Mayor and Council appropriation.

Next Steps
Upon the Mayor and Council approval, the Procurement Department will secure insurance, issue
the rider agreement and issue a Master Agreement to ATC Corporation for services consistent with the pricing in the Baltimore County Contract SCON-10002601-1.
