Recommendation
Staff recommends that the Mayor and Council authorize the City Manager to execute two proposed easements between the Mayor and Council of Rockville and Pulte Home Company, L.L.C., in conjunction with the 5906 Halpine Road redevelopment on Parcel A-1 and Lots 1 and 2, MetroPlace at Twinbrook.
Discussion
This item seeks Mayor and Council approval of, and authorization for, the City Manager to
execute on its behalf the following grant of easements associated with the redevelopment at 5906 Halpine Road:
1) Grant of Public Improvements Easement
2) Grant of Water Meter Easement
A Project Plan (PJT2024-00019) for the proposed development of up to 36 two-over-two stacked residential condominium units was approved by the Mayor and Council at its meeting of September 9, 2024. A Level II Site Plan (STP2024-00474) to implement the Project Plan was approved by the Planning Commission at its meeting of October 9, 2024.
The Applicant, Pulte Home Company L.L.C., is required to provide easements and to subsequently obtain Public Works approvals and permits in accordance with the Project Plan and Site Plan approvals.
1) Grant of Public Improvements Easement
This item authorizes the City Manager to approve a Grant of Public Improvements Easement in accordance with the project’s Site Plan requiring the Applicant to grant a minimum 1-foot Public Improvements Easement (PIE) adjacent to the public right-of-way for Ardennes Avenue.
The purpose of the Public Improvements Easement is to provide the area necessary for the City to access, maintain, repair, replace and inspect public sidewalks that abut the property. The additional one foot that is typically provided behind the sidewalk allows for excavation and form construction. The location of the proposed easement is shown in Attachment 1. The draft document is provided in Attachment 2, “Grant of Public Improvements Easement.”
2) Grant of Water Meter Easement
This item authorizes the City Manager to approve a Grant of Water Meter Easement for the water meter vault servicing the residential buildings in areas not dedicated as right-of-way. The developer is required to locate the proposed water meter in an easement dedicated to the City and obtain Public Works approval and permits in accordance with the City’s Water and Sewer Ordinance, Chapter 24, and Public Improvements Ordinance, Chapter 21.
The purpose of the Water Meter Easement is to grant the City rights to access, maintain, repair, replace, operate and inspect the City-owned water service line, water meter, vault and associated appurtenances. The location of the proposed easement is shown in Attachment 1. The draft document is provided in Attachment 3, “Grant of Water Meter Easement.”

Next Steps
If approved by Mayor and Council, the City Manager will ensure the execution of the following listed documents in a form substantially similar to the draft documents attached to this agenda and as approved by the City Attorney:
1) Grant of Public Improvements Easement
2) Grant of Water Meter Easement
The documents will be recorded in the Land Records of Montgomery County prior to issuance of associated Public Works permits.
