Recommendation
Staff recommends that the Mayor and Council award and authorize the City Manager to execute a rider agreement for an amount not to exceed $350,000, annually, subject to appropriations, with terms and pricing consistent with City of Gaithersburg contract RFB2024-009, for a construction services contract for city roadway resurfacing, curbs, sidewalks and miscellaneous appurtenances to Olney Masonry. Corp., of Beltsville, Maryland, through June 30, 2026, with the option to extend for (2) two additional years through June 30, 2028, consistent with the City of Gaithersburg’s extensions and renewals.

Discussion
This rider contract provides the city with a mechanism to maintain and provide asphalt and concrete improvements to the infrastructure of the city’s parks and buildings, including roadways (within parks and facility grounds), sidewalks, ADA improvements, pathways, parking lots, plazas, curb and gutters, drainage systems, culverts, railings, fences, bollards, line striping, athletic courts, and pervious pavement.

Mayor and Council History
This is the first time this Rider Agreement has been brought before Mayor and Council.

Procurement
Staff believes this contract is the best for the city because the scope fits the city’s needs and the City of Gaithersburg’s contract has multiple line items with estimated quantities larger than the city's and, as such, provides more competitive pricing based on higher volume.
Olney Masonry is a State Certified MFD-V business.
In accordance with Section 17-71 of the Rockville City Code, Cooperative Procurement; (b)
The City may contract with any contractor who offers goods, services, insurance or
construction on the same terms as provided other state or local governments or agencies
thereof who have arrived at those terms through a competitive procurement procedure
similar to the procedure used by the City.
In accordance with Section 17-39 of the Rockville City Code, Awarding Authority, (a) All
contracts involving more than two hundred and fifty thousand dollars ($250,000.00) shall be
awarded by the Council.

Fiscal Impact
This award supports operating and capital activities that require asphalt and concrete repairs and construction. Funding within the Parks and Facilities Maintenance Division FY 2026 operating budget and within the Recreation and Parks Program Area FY 2026 capital budget support this award. All future funding is subject to Mayor and Council appropriations.

Next Steps
Upon the Mayor and Council approval, the Procurement Department will obtain the Contractor’s insurance, complete execution of the Rider Agreement, and issue a Master Agreement to Olney Masonry for services.
