Executive Summary

Macris, Hendricks & Glascock, P.A. (“Applicant”) has filed this Final Record Plat application on behalf of 22 West Jefferson St, LLC (“Property Owner”) to create one record lot and dedicate approximately seven feet to the Maryland State Highway Administration/Department of Transportation for use as right-of-way for West Jefferson Street (MD 28). Construction on the lot is currently underway per approved Level 2 Site Plan STP2023-00449, approved by the Planning Commission on April 12, 2023. The approval authorized construction of a residential development consisting of 12 multi-family units, 17 townhouse units, and other associated infrastructure improvements.

 

The Zoning Ordinance defines a Final Record Plat as:

 

A map that illustrates a metes and bounds description of the property into a system of lot and block numbering, the naming of the tract (subdivision name), and the assignment of a plat number when recorded among the Land Records of Montgomery County, Maryland.

 

Pursuant to Section 25.21.11.g of the Zoning Ordinance, the Planning Commission is the Approving Authority for Final Record Plats. The approval and recordation of a Final Record Plat creates record lots, which are then deemed buildable lots per the Zoning Ordinance.

The Property is approximately 1.25 acres in size and located along the south side of West Jefferson Street, midblock between South Washington Street to the east and South Adams Street to the west. The site is in the shape of an inverted “L” with approximately 211 feet of frontage on West Jefferson Street and a length of about 322 feet deep.  The Property is zoned MXT (Mixed-Use Transition) and is described as being Lot 15, Block 2 of the Original Town of Rockville subdivision. A portion of the lot is within the South Washington Street Historic District. A 3-story, 23,000 square-foot office building, constructed in 1959, is being redeveloped into 12 multi-family units. East of the building, four new townhouses are under construction. Behind the building, construction of 13 townhouses will soon commence.  The area behind the building is currently an asphalt paved parking lot.  The pavement extends across to the paved parking and driveway area of the adjoining church to the east.  There is substantial vegetation and mature trees along the west property line adjacent to the single-family houses along South Adams Street. 

 

Project Description

The Applicant proposes to resubdivide an existing record lot to create a new record lot and dedicate 7 feet of property frontage to the State of Maryland for use as public right-of-way. The current record lot (Lot 15, Block 2) is 1.25-acres and the new record lot (Lot 16, Block 2) will be 1.21 acres. The difference, (.04 acre or 1,479 square feet) will be dedicated as public right-of-way. Access to the proposed lot will continue to be from West Jefferson Street. The proposed lot frontage is approximately 211 feet and the depth is 315 feet. The Property is encumbered by multiple access, utility and stormwater management easements.

Project Analysis

Master Plan

The Property is located within Planning Area 4 - West End and Woodley Gardens East-West. During review of Level 2 Site Plan STP2023-00449, the Planning Commission determined that STP2023-00499 was in compliance with the City’s Rockville 2040 Comprehensive Plan. Several elements of the project application are compliant with goals, policies and actions outlined in the Planning Area 4 chapter of the Plan. These compatibilities included an improved streetscape on the West Jefferson Street frontage and the Plan’s recommendation that single-unit attached residential uses be allowed if the existing building is reoccupied or the property is redeveloped.

 

Zoning Ordinance Compliance

The proposed Final Record Plat meets the conditions of approval as defined in Section 25.21.02, Final Record Plats, of the Zoning Ordinance.

 

The site is zoned MXT (Mixed-Use Transition Zone). The Planning Commission found, based on staff review and recommendation, that the Level 2 Site Plan was consistent with Zoning Ordinance requirements. All development standards and open area and public use space requirements have been met. In addition, the Applicant complied with the landscaping and parking requirements of the ordinance.

 

Adequate Public Facilities Standards (APFS)

A determination of Adequate Public Facilities was made with the Level 2 Site Plan application. The Final Record Plat is consistent with the Level 2 Site Plan approval, and therefore the determination of adequate public facilities remains in effect.

 

Historic Review

The Property is split by the South Washington Street Historic District boundary. On September 15, 2022, the Historic District Commission (HDC) approved Certificate of Approval application HDC2022-01080, to construct 4 three-story townhouse style condominiums. The Applicant provided architectural exhibits as part of the Level 2 Site Plan that were generally consistent with HDC’s approval.

 

Previous Related Actions

                     In 2004, the Board of Appeals approved Special Exception application SPX2004-00347 to permit the expansion of the existing Christ Episcopal School located at 107 - 119-½ South Washington Street into the office building on the Property. The intent at that time was that student enrollment for the school would increase to 397, and as tenants of the office building gradually vacated the building, the interior of the building would be remodeled for school use and prepared for student and staff occupancy.

                     In 2010, the Board of Appeals approved Special Exception Application SPX2009-00377 to create a new outdoor play area and modify certain conditions of approval as imposed by the Board of Appeals in its grant of Special Exception SPX2004-00347. The conditions modified pertained to the drive aisle width and driveway apron on West Jefferson Street and contribution towards traffic mitigation.

                     The Planning Commission approved Level 2 Site Plan STP2023-00499 on April 12, 2023. The approval allowed redevelopment of an office building into 12 multi-family style residential units and development of 17 new townhouse units, as well as open space and surface parking serving the residential development on the Property and the adjacent Christ Episcopal Church and School.

                     On May 17, 2023, the Board of Appeals approved Special Exception SPX2023-00403. The Applicant, along with their neighbors The Vestry of Prince George’s Parish in Montgomery County Maryland (Christ Episcopal), sought a major modification to an existing Special Exception in order to relocate Christ Episcopal School from the 22 West Jefferson building and consolidate the school operations entirely within the Christ Episcopal properties located at 107 - 119 ½ South Washington Street. A 30% parking reduction was also requested and approved under the same special exception application.

                     On July 16, 2023, the Planning Commission approved Final Record Plat PLT2023-00617 to consolidate parts of three records lots and part of former Church Street into one record lot, Lot 15, Block 2 of the Original Town of Rockville subdivision.

 

Community Outreach

Public notification of the Final Record Plat was made pursuant to the requirements of Section 25.21.11.d (Notice). Mailed notification was provided to all property owners within 750 feet from the Property as required by the Zoning Ordinance. At the time of this report, no public testimony or inquiries have been received regarding the Final Record Plat application.

 

The 22 West Jefferson Street development project was subject to various public hearings before the Planning Commission. Additionally, the Site Plan required neighborhood area meetings at the pre-application stage and post-application stage.

 

Findings and Recommendation

There are no required findings that need to be made as part of the approval of this Final Record Plat. The plat is in compliance with the approved Site Plan for the Property, and the plat meets the conditions of approval as defined in Section 25.21.02 - Final Record Plats of the Zoning Ordinance.

 

Staff have been in communication with the Maryland State Highway Administration, and the State is supportive and accepting of the proposed right-of-way dedication. Staff recommend approval of Final Record Plat Application 2026-96-PLT, subject to the conditions in this report.

 

Conditions

Planning and Zoning

1.                     The Final Record Plat submission must include the original mylar plat and three mylar copies.

2.                     The Final Record Plat application shall be submitted in an appropriate electronic format as specified in Section 25.21.10.d of the City of Rockville Zoning Ordinance.

Public Works

3.                     The Applicant must grant to the City a Public Access Easement (PAE) across the entire width of the privately maintained alleys as shown on the proposed site plan. The PAE must be granted by separate document from the Final Record Plat, reviewed and approved by DPW and the Office of the City Attorney, and recorded in the Montgomery County Land Records.

4.                     Prior to the recordation of a Final Record Plat, the Applicant must submit for review and approval by the Office of the City Attorney all necessary deeds, easements, agreements, dedications, and declarations. Drafts of the documents must be included with the initial submission of the engineering plans and must be recorded prior to issuance of DPW permits, unless otherwise allowed by DPW. All dedicated easements must be referenced on the Final Record Plats.

5.                     Prior to the recordation of the Final Record Plat, the Applicant must secure the termination or abandonment of all existing easements as necessary for the construction of the development, including all easements located in proposed rights-of-way. Termination or abandonment of such easements must be evidenced by recordation of a deed of termination or abandonment in the Montgomery County Land Records. Abandonment or termination of any easement granted to the City must be approved by the Mayor and Council of Rockville, and prior to recordation, any deed of abandonment or termination of an easement granted to the City must be reviewed and approved by DPW and must be in a form approved by the Office of the City Attorney.

6.                     The Record Plat must include:

• Additional dedication of right-of-way to Maryland State Highway Administration (by the     Applicant) for improvements to the south side of West Jefferson Street; and

• All necessary easements and abandonments.
