Recommendation
Staff recommends that the Mayor and Council authorize the City Manager to amend an existing stormwater management easement recorded at Book 66981, Page 40 in the Montgomery County Land Records in conjunction with the King Buick redevelopment.
Discussion
This item seeks Mayor and Council approval of and authorization for, the City Manager to execute on its behalf the amendment and restatement of an existing stormwater management easement recorded at Book 66981, Page 40 in the Montgomery County Land Records.
As part of the King Buick redevelopment, the Applicant, KBSG Associates LLC, was required to provide an easement to the City for stormwater management facilities in areas not dedicated as Right-of-Way (ROW) and received permit approval to install the facilities serving the new subdivision. The easement will be amended to include an additional private owner, Pulte Home Company LLC, and easement revisions to accommodate relocation and removal of stormwater management facilities.
The locations of the existing easement and proposed easements are shown (Attachment 1). The draft documents, “Grant of Amended and Restated Stormwater Management Easement” (Attachment 2) and “Recorded Stormwater Management Easement” (Attachment 3), are also provided.

The Mayor and Council authorized approval of the initial stormwater management easement at its October 3, 2022, meeting on consent agenda item 7.B.
Next Steps
If approved by Mayor and Council, the City Manager will ensure the execution of the documents entitled, “Grant of Amended and Restated Stormwater Management Easement” in a form acceptable to the City Attorney and substantially similar to the draft documents attached to this staff report. The executed easement documents will be recorded in the Land Records of Montgomery County prior to the issuance of associated Public Works plan and permit revisions.
