Executive Summary
Church of God - Iglesia de Dios of Rockville, Inc. (“Applicant”) proposes to resubdivide Lots 8 and 9, Block 1 of the Janeta Subdivision.
The Zoning Ordinance defines a Final Record Plat as:
A map that illustrates a metes and bounds description of the property into a system of lot and block numbering, the naming of the tract (subdivision name), and the assignment of a plat number when recorded among the Land Records of Montgomery County, Maryland.
Pursuant to Section 25.21.11.g of the Zoning Ordinance, the Planning Commission is the Approving Authority for Final Record Plats. The approval and recordation of a Final Record Plat creates record lots, which are then deemed buildable lots per the Zoning Ordinance.

Site Analysis
The proposed subdivision being reviewed as part of this application consists of two existing lots, with Lots 8 and 9 having a land area of approximately 14,400 square feet (0.33 acres) each. The subject property is located within the south-eastern corner of the East Rockville Neighborhood, near the northwestern quadrant of the intersection of Viers Mill Road and First Street, and is bounded by First Street to the east, Grandin Avenue to the north, and an alley to the south. Zoned R-60, the property is currently developed with a church building that is located on lot 9 and a storage shed that is located on lot 8. The property is surrounded by residential detached single-family dwellings in all directions.

Project Description
Final Record Plat PLT2025-00641 will create an approximately 28,764 square-foot lot, creating Lot 10, Block 1 of the Janeta Subdivision. The proposed new lot will include a 10-foot-wide Public Utility Easement (P.U.E.) and 2-foot-wide Right-of-Way Dedication with an area of approximately 323 square feet. In total, approximately 646 square feet of the lot will be dedicated to public use.

Project Analysis
Zoning Ordinance Compliance
This Final Record Plat meets the conditions of approval as defined in Section 25.21.02, Final Record Plats, of the Zoning Ordinance. The site is currently improved with a church building, and place of worship is permitted use in the R-60 Zoning District.
Section 25.21.22.b of the Zoning Ordinance requires that in any resubdivision of developed or undeveloped lots within an existing residential area, the plat must maintain, to the extent feasible, the average area and frontage of existing lots within five hundred (500) feet of the proposed resubdivision. Staff notes that this requirement is intended to assure that new residential lots within a residential area are compatible with the surrounding development pattern. This situation involves creating a larger lot to accommodate an existing and permitted institutional use to bring it further into compliance with the code, and as such is not applicable.

Previous Related Actions
Two use permits were filed for the subject property. Use Permit USE2002-00644 was approved to permit the construction of a storage shed on Lot 8 for the church and Use Permit USE2004-00680 was approved for the construction of a parking lot on Lots 8 and 9, associated with the church. The shed was constructed on Lot 9; however based on City records and the existing site conditions, the parking lot was not constructed.

Community Outreach
Public notification of the Final Record Plat was made pursuant to the requirements of Section 25.21.11.d (Notice). Mailed notification was provided to all property owners within 750 feet from the subject property as required by the Zoning Ordinance. At the time of this report, no public testimony or inquiries have been received regarding the Final Record Plat application.

Findings and Recommendation
There are no required findings that need to be made as part of the approval of this Final Record Plat, and the proposal meets the conditions of approval as defined in Section 25.21.02 - Final Record Plats of the Zoning Ordinance.
Staff recommend approval of Final Record Plat Application PLT2025-00641, subject to the conditions in this report.

Conditions of Approval
Planning and Zoning
1. The Final Record Plat submission must include the original mylar plat and three mylar copies.
2. The Final Record Plat applications shall be submitted in an appropriate electronic format as specified in Section 25.21.10.d of the City of Rockville Zoning Ordinance.
Forestry
3. Upon the future redevelopment of the subject property, the applicant is required to meet the requirements of Section 25.21.21 of the Zoning Ordinance as it relates to street tree and lot tree requirements.
DPW Engineering
4. The Final Record Plat must include additional dedication of right-of-way (by the Applicant) for improvements to the existing alley.
5. The Final Record Plat must include all necessary easements and abandonments.
