Recommendation
Staff recommends that the Mayor and Council authorize the City Manager to execute a Water Meter Easement between the Mayor and Council of Rockville and Toll Mid-Atlantic LP Company, Inc., in conjunction with the Washington Square redevelopment at Lot 3, Block A, City Center, 622 Hungerford Drive.

Discussion
This item seeks Mayor and Council authorization for the City Manager to execute on its behalf a Grant of Water Meter Easement associated with the Washington Square redevelopment. The location of the proposed easement is shown in Attachment 1. The draft document is provided in Attachment 2, “Grant of Water Meter Easement.”
A Level II Site Plan (STP024-00490) for the proposed mixed-use development of up to 48 residential condominium units was approved by the Planning Commission at its meeting of February 19, 2025.
The Applicant, Toll Mid-Atlantic LP Company, Inc., is required to provide a Grant of Water Meter Easement and to subsequently obtain Public Works approvals and permits in accordance with the Site Plan approvals.
This item authorizes the City Manager to approve a Grant of Water Meter Easement for the water meter vault servicing the residential buildings in areas not dedicated as right-of-way. The developer is required to locate the proposed water meter in an easement dedicated to the City and obtain Public Works approval and permit in accordance with the City’s Water and Sewer Ordinance, Chapter 24, and Public Improvements Ordinance, Chapter 21.
The purpose of the easement is to grant the City rights to access, maintain, repair, replace, operate and inspect the City-owned water service line, water meter, vault and associated appurtenances. The approximate location of the water meter easement is shown on the site plan exhibit (Attachment 1) and is specifically located by survey metes and bounds as an attachment to the easement document.

This is the first time this item has been brought before the Mayor and Council.

Next Steps
If approved by Mayor and Council, the City Manager will execute the Grant of Water Meter Easement in a form substantially similar to the draft document attached to this agenda and as approved by the City Attorney.
The document will be recorded in the Land Records of Montgomery County prior to issuance of associated Public Works permit.
